These Terms of Service ("Terms") govern your access to and use of everide.cc and your purchase of products from EVERIDE.
EVERIDE is operated by HABITAT NEXUS LIMITED ("EVERIDE", "we", "us" or "our").
By accessing our website or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use our services.

You must have the legal capacity to enter into a binding contract under the law applicable to you in order to place an order through EVERIDE.
If you purchase on behalf of a business or organization, you confirm that you have authority to bind that organization.
3. Products and Product Information
We aim to provide accurate product descriptions, images, measurements, sizing information, colors, specifications and availability.
Colors and appearance may vary depending on photography, lighting and device displays. Measurements and weights may also be subject to reasonable manufacturing tolerances.
Product fit may vary between brands, collections and product categories. Customers should review the individual product size guide and fit information before ordering.
4. Product Selection
EVERIDE is an independent retailer. References to brands, manufacturers or product technologies do not imply that EVERIDE owns those brands unless expressly stated.
Product availability, brand selection and product ranges may change without notice.
5. Prices
Prices are displayed in the currency selected or presented for your market where available.
Prices, promotions and discounts may change from time to time. The price applicable to your order is the price confirmed at checkout, subject to correction of obvious errors.
Taxes, duties, shipping charges and other applicable costs will be displayed or described at checkout where available.
6. Orders
Submitting an order is an offer to purchase the products in your cart.
Receipt of an automated order confirmation does not necessarily mean that the order has been finally accepted. We may review an order before fulfilment.
We may refuse or cancel an order where reasonably necessary, including where:

- pricing or product information contains an obvious error;
- fraud or unauthorized activity is suspected;
- delivery to the provided address is not available; or

If we cancel an order after payment has been collected, the appropriate amount will be refunded.

You confirm that you are authorized to use the payment method supplied and that the information provided during checkout is accurate.
8. Shipping and Delivery
Shipping destinations, delivery methods, estimated delivery times and charges are described in our Shipping & Delivery Policy and at checkout.
Delivery dates are estimates unless expressly stated otherwise.
Customs clearance, weather, carrier disruption, public holidays and other circumstances outside our reasonable control may affect delivery times.
9. Duties and Taxes
For supported destinations, EVERIDE covers applicable import tariffs, duties and customs charges associated with delivery.
Taxes, duties or import charges may be handled through checkout, the carrier or EVERIDE's logistics process. Customers should not be required to pay unexpected import charges at delivery for an order covered by this policy.
If an unexpected import payment is requested, please contact EVERIDE before paying the charge so we can review and assist.
10. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Returns & Exchanges Policy.
EVERIDE provides eligible customers with a voluntary 60-day return policy. Standard voluntary returns are subject to a fixed US$20 return fee per return request.
Approved size exchanges are free of charge.
The voluntary return policy operates in addition to, and does not limit, mandatory consumer rights that apply to you.
11. Faulty or Incorrect Products
If a product is faulty, damaged on arrival or incorrectly supplied, contact EVERIDE as soon as reasonably possible with your order number and relevant information or photographs.
Nothing in these Terms limits any mandatory consumer rights or remedies relating to defective or non-conforming goods.
12. Promotions and Discount Codes
Promotional codes and offers are subject to their stated conditions.
Unless expressly stated otherwise:
- discount codes cannot be exchanged for cash;
- discounts apply only during the stated promotional period;
- discounts may be restricted to specified products or markets;
- multiple discounts may not be combined; and
- where more than one promotion is available, Shopify may apply the eligible promotion permitted by the checkout configuration.
13. Gift Cards and Store Credit
Gift cards and store credit, where offered, are subject to any additional conditions displayed when they are issued.
They may not be redeemable for cash except where required by applicable law.
14. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
Please contact us if you believe your account has been accessed without authorization.
